Re-entry after overstay, and possibility of a fiance visa
OK. Came here on work visa 1998. Gained ss card drivers lic. Went home to Newzealand. 1999 came back on visitor visa overstayed 3 years. Left with no problems. 2002 came back on visa waiver and been here 4 years. Waiting for BF to finalize divorce to get married. Father had a heart attack in New Zealand and I must go home. Heres my questions. Will I have problems leaving? When I come back can I use the visa waiver programme again or will they see I over stayed. Should I leave through Canada, that way I could say I did leave 4 years ago. What are the chances and time frame of filling for fiance visa if Im in New Zealand and will my overstaying affect me getting that visa? Again I am not being deported no one knows im here. I work have a house use my ss card even though it says I can only work with ins aproval.

sorry....i came back pre 9-11. I know things have changed since then but from what I can tell the only way ins can see I overstayed is my i94 has not been handed in. So how can they tell I didnt leave via land port or the airline lost it. Once I get home I will be renewing my passport so I will have no prior stamps in my passport.

Yor best bet is to stay and get married and wait till you get your Green card before you leave USA, At this moment i can only tell you that they are waiting for you and once you leave, hmm you will be barred for 10 years trust and its a must. That is what i know and have heard and read sdo far, Dont leave, Your dad is sick but think about your situation and your future too.
Number 2, please consult an immigratin lawyer ASAP but i can assure you that he/she will tell you not to leave and wait for who ever is getting the divorce to get it and you marry and then get your papers sorted at least get your Green card, After 9-11 hmm They know everything and you must be lucky to hve got in like that.
