Airbags Didn't Deploy in a Car Accident
My question involves an injury that occurred in the state of: Virginia

Back in March I was involved in a single car accident. I was traveling with the flow of traffic (approx 60 MPH) and noticed that traffic was at a stop ahead of me. When I tried to apply my breaks, nothing happened. As part of my reaction to avoid hitting the stopped cars in front of me, I guided my car towards the left shoulder. While doing so, another car cut in front of me forcing me to make a more drastic steering change. At 60 mph, with the sudden steering change to the left, my 2005 Durango went into a full spin. Luckily I missed the other cars on the road, however my car was a total loss after hitting the concrete wall on the shoulder. The front of my car hit first, spun around hitting the side, then resting on the rear. The frame of my car was completely bent, as were the axles. After such a serious collision, neither my front or side impact airbags deployed.

I was taken to the shock trauma unit at the hospital where I was later released. Since I was working, my claim fell under workers comp... a nighmare to deal with on it's own!

Since dealing with the workers comp docs who tell me that my pain is gone and nothing is wrong with me, I'm still in pain after sitting or standing for extended periods of time. Dealing with these people brought me to the point where I gave up on trying to get more treatment. After speaking with friends, most think that I should seek legal advice on how to deal with the workers comp frauds. They also feel that I may have a case against Dodge over the airbags.

    Any advice will be appreciated.

    Regards,

    APB

    Re: No Airbag Deployment
It isn't clear from your description of the accident - sort of a spinning collision that started in the front of your car but apparently was something quite different from a classic head-on crash - that the airbags should have deployed or that their deployment would have affected your injuries. This is a complicated analysis, so I suggest finding a lawyer who handles automobile product liability cases in your state and having the lawyer review the accident reports and photographs. If the car is still available in post-crash condition for inspection, try to keep the condition unchanged until it has been inspected for possible failure of the airbags.

It is also possible that the deceleration rate of your accident was not enough to strike the pendulum switch in the airbag control module.
