    Refused entry due to overstay
    Hi I was refused entry becus i overstay my visa waiver programby 4 days and was told to go back and apply for a normal visa to come to the USa, I would like to know if inthis case I am barr for 3 years or 10 years or i have no bar.

    The custoom border officer or immigration officer at the POE said you need to apply for a visa to come for a visit sir and made me sign some papers.
    In this case, was i deproted? or was i refused entry and how can i request for my files.
    Will USCIS tell me that i dont have a barr as the officer did not talk about a barr but only said go and get a visa, it was august 2004.

    You may be able to find out if you are subject to a period of exclusion by inquiring with U.S. Customs and Border Protection. I don't know why a customs officer would mislead you by indicating that there was no bar, if in fact one applied.

    Hi Sir, The officer told me that I just have to apply for a visa back home to come and visit and he told me there is no barr since i only overstayed for 4 days as that is my 1st violation of the US immigration law after vsiting the country for 7 times and have always left accordingly.

    I have asked an immigration lawyer on this and i was told that likely i will not have any bar on me but to wait for a while before i apply for a B2- or B1 visa, its been since august 2004 so ina nutshell I just want to know if it is ok to apply to visit this summer ?

    You are in consultation with an immigration lawyer. The best person to ask for specific counsel is your lawyer, as your lawyer is familiar with all of the facts and circumstances of your case.
