Masturbation in a Locker Room
My question involves criminal law for the state of: California
I have a friend that just called me and said he had a "spa day" at a legitimate spa (actually a very nice one) and while he was in the shower (a private shower with a door) he couldn't help himself and masturbated. I told him if no one saw him, then nothing can happen, but he is worried they have cameras in the showers and will review it and then have him arrested.
I guess this brings up a few questions:
1. Can a spa place cameras inside the shower?
2. Even if they did, and watch it, isn't this a private area? Its not public, and the shower was private.
3. What would the charge be?

I'm with ya, but nonetheless it happended.
I think I found that its illegal to place cameras in places like bathrooms in California, so there shouldn't be one at all, and if so, they'd have to admit to breaking the law.

I cannot think of a charge that might apply unless it might involve the expulsion of noxious waste.
Not only would a camera in a shower stall run afoul of one state law or another, but absent someone to view the exposure of the genitalia, I cannot see a charge that might apply here.

Thats awesome. You brought up a good point - if no one actually saw it (other than on a camera), then what could the crime be? I guess I assumed that someone seeing it on camera counted as "exposure" - but if the camera is illegally placed then maybe not.

To echo the other posters:
1. Placing a camera in a shower of a spa would be illegal, period. It makes no difference what the state is.
2. There is a reasonable expectation of privacy.
3. As any video evidence would be illegal, it would not be admissible and could not result in any criminal charges.
