    Child Support Payments in Illinois
My question involves child support in the State of: Illinois

My ex-girl friend and I dated for a year about a year ago. She had my child and I was wondering how child support is calculated in Illinois. A link where I can read up on it would be great.

Also, we were never married. She has many more assets than myself but is hiding them in order to get more child support from me.

She currently lives in another state if that helps.

    Any information is appreciated.

    Thanks!

    Did you try googling it?

(It would appear that her income has nothing to do with it....)

    thanks for the link :)

Looks like I'm going to be paying 20%. Can you recommend any Chicago land attorney? I'd rather go through a recommendation than getting hundreds of matches on the internet.

    Thanks!

    Wait.

    Mom lives in another state?

    WHICH state?

Child support will be calculated according to the guidelines where the CHILD lives...

(The site also doesn't provide referrals :) )

The mother lives in California - that's where she has filed her paperwork up to this point. The child was conceived in Illinois is that helps.

    Thanks for your help :)

Right then. It will be according to California law provided Mom has been there long enough to be considered a resident for child support purposes.

    California info is right here

When you say she's hiding assets, what exactly do you mean by that?

    (you're very welcome, btw!)

She moved to California recently - about a year ago. Child was delivered in California about 6 months ago.

She works in Finance (trading) - she made a lot of money in the stock market during the real estate boom. When we split, she had saved up about $350k. After she delivered, she transferred that money into a friends name, hoping the courts would award her more child support by appearing broke on paper. I have no problem paying child support - I just don't want to over pay, considering she has a lot more than me.

    Thanks!

Can you prove that the money wasn't transferred as a gift?

(also she now is a resident of CA, hence CA child support guidelines would be used)

I really can't prove it - but I know there is no way she spent it, considering she continues to work in finance, but in California. I checked out the California link above, and it looks like her income will be taken into account (she makes 3x as much as myself).

Thanks for all the info - I really appreciate it.

    You're welcome :)

Be prepared for her to lie her butt off if you even raise the issue of her savings.

And be prepared for a judge to tell you it doesn't matter anyway...not saying that's going to be the case, but it's not outwith the realm of possibility.

California will base support on combined income and time share. I've never heard of a child support order being issued based on what one parent has in savings. Hiding assets would only matter if you two were married and arguing about assets attained during the course of the marriage.

You should seriously consider hiring an attorney in her jurisdiction.

Thank you both so much for helping.

Would you recommend I start paying child support asap or should I wait for the court order before I start making payments?

    Thanks!

Her assets matter not, and the fact that she makes 3x more than you HURTS you more than it helps you, especially if she has the majority of the timeshare (which she does). It's also not going to help you that child care in CA is HORRIDLY expensive, especially for an infant.
