    Caught Shopliifting in Wal-Mart in Oregon
    My question involves criminal law for the state of: Oregon

    I'm 18 and I was caught shoplifting makeup ($ 120)in wal-mart 2 days ago, and it was my first time being arrest. After being arrested, i promise myself that i would shoplift no more.the feeling is just terrible.:wallbang:
    I was charged for theft 2, and i'm going to a community court on wednesday.

    so i have a couple questions:
    1. what is theft 2 mean? (p.s. on my paper there is the word "R" what does it mean?)
    2. what will happen in community court?
    3. will i go to jail?
    4. if i plead guilty, what will happen to me?

    I'm going to the court tommorrow and have no idea what i should i do?
    should i plea guilty or not guilt?
    i don't have money to get an attorney...
    so should i plea not guilty to get a PD?
    If i plea guilty, am i able to enter to a diverdion program?

    We're all volunteers. We may not be able to respond immediately. Additionally, posting multiple times doesn't help because it makes the thread look busy, so it looks as though someone else has already answered your question.

    In the event that you check this thread in the morning before going to court, please note:

    1. Theft 2 is what you are charged with. It's an A misdemeanor. I'm not sure what you're asking regarding the "R" as that part is not very clear.

    2. When you first go to court, you will be going in for a hearing called an arraignment. At the arraignment, you will told what the charges are and asked to enter a plea. ALWAYS plead not guilty at arraignment! The prosecutor may ask the judge to set bail, and the judge may set bail. (You might be released without bail.) If you can't afford a lawyer and need a public defender, you should also ask for one at arraignment.

    3. Jail is very unlikely for a first offence, but is always technically possible. Assuming you don't plead guilty at arraignment (and you should NEVER plead guilty at arraignment), then you won't be sent to jail after your first court appearance; there will be hearings and potentially a full trial before you can be sent to jail if you get sent there at all.

    4. If you plead guilty, you will be convicted and sentenced. You'll forfeit any chance to get a reduced charge, as well as any chance to get into a diversion program or other method of disposing of the charge without a conviction. You may be sentenced to probation and fines, you may be sentenced to jail, but you'll definitely be sentenced. I've already said it twice, but this is important: DO NOT PLEAD GUILTY.

    If you plead guilty, you CANNOT get into a diversion program, you are already convicted.

    Plead not guilty, ask for a public defender, and discuss a diversion program with your public defender. If you can get into one, he'll know how to do it; that's his job.

    Additionally, please be mindful of a few rules regarding courtroom etiquette and such. My apologies if that advice is considered blazingly obvious to you and condescending by the implication that you may not be aware of it, but you'd be surprised how many people don't know such things. I've seen many a courtroom where such manners were forgotten by most involved.

    so as long as i plea for not guilty,
    my PD can arrange a diversion peogram for me?

    hey, my expericnce happened i florida between april17 and march.i was caught and charged for the first time for petie thef which happened inwalmart. i had no prior arrests and an not a citizien nor resident of the u.s. thru ALL this i was finally given probation for 1year no jail time and this was with held from my record.


    unforuntanley i was caught again shopliffting out of walmart but this time i ran from the officer so now am charged with resisting arrest and theft both are misdemeanors.basically what i wanted 2 know is what is the possibality of me getting jail time and if so how long do u think for those charges seen that probation was violated. and what questions do u think i should ask my public defender when we meet. and if it possible that my prior sentence can be regiven.another question is if i do get sentence 2 jail and itslike a yr, do one acctually do a full yr? last for those chargres what do u think is the maximum jail time? thanks 4 ur help in advance
