Minor in Possession, in California
My question involves criminal law for the state of: California
Last night I was pulled over and ticketed for Minor in Possesion of alcohol and several mechanical issues. I had three twelve packs of beer in my truck and this is my first offense. I'm 17 and have had my license for just over a year. I was directed to contact the probation department sometime in the coming week. I have seen some posts saying my license will be suspended and some posts saying that my license may not be suspended. I'm really just looking for some clarification, but is there any way for me to avoid having my license suspended for the whole year if I can't avoid a suspension.
Thanks.
Re: Minor in Possession California
Your license is toast.
What, exactly, were you charged with?
Re: Minor in Possession California
Minor in possession, no proof of insurance (we just recently purchased the truck), and having a license plate cover. I was also told i needed to have mudflaps and better lighting around my license plate. I spoke with a couple local sheriff deputies today and they told me that probation was probably going to place me on informal probation for six months to a year and that I probably wouldn't lose my license for the whole year. They said it would probably be about a month
Re: Minor in Possession, in California
What are the specific CODE sections you were cited with?
If cited for a municipal code for being a minor in possession of alcohol, your license will likely be just fine. If cited for a violation of state law, you may very well lose your license for a year.

Yes, if suspended the court "shall" suspend your license for a period of one year. You can, however, apply for a restricted license that will allow you to travel to and from work or school.
