For starters, it would be sexual assault (§ 22.011). Additional charges would also be possible, depending on circumstances.
So, let's review your "friend's" state of being.
He is schtupping a CHILD.
If found out... and ANYONE that knows of/hears about/suspects the relationship can turn him in (NOT just the parents of the raped child)... he gets to go to prison for a decade or more for every single sexual action he took with the child.
Has he ever heard the expression "15 gets you 20"? There is more than a bit of truth to that... and your friend is on the sharp end.
Tell your friend to stop feeling like a big man because he can rape a child... and to start wondering what it will feel like to have his sexual favors passed around the old cell block for an extra pudding cup.
He is going to HATE prison... child molesters usually do.
First of all he was accused. When things like this comes up people forget that sometimes people don't do what someone accused them of. I wanted to know what the charge should be because the charge they have him under does not go with what the girl said in her statement. I thought this forum was for help with legal question and not to attack the person or people that the question is about or that asked the question!
I have a cousin that was 14 and was telling people that she was 19 and was sleeping with older men. These teens now days are wild and there parents don't care most of the time. I have two daughters and I refuse to allow my girls to do such a thing!
Without knowing EXACTLY what the victim said in her statement, we can't evaluate if the standing criminal charges fit or not (but apparently whomever decided on those charges was confident that the elements of those particular charges were met). Whether they actually are or not is why we have juries to determine if the crime was committed as charged.
As for the remark to the pudding you both need to grow up! For all who has read my post and has already convicted him in your minds put yourself in the position of being falsely accused of something so horrible! My friend has witnesses to help him and prove that he is innocent. Thank you aardvarc for answering my question and not putting horrible remarks in your posting.
The girls said that she had sex with him three different times.
Grow up? At least I'm not being charged with having illegal sex with a 14 yo kid.
there is a real simple way for a 23 you adult to not get accused of raping a 14 yo kid; don't hang around with 14 yo kids.
your "friend" had to have put himself in a position where the girls story is believable. Before people are charged, the crime is investigated.
your refusal to allow it doesn't mean a thing if that is what they want to do. You can't be with them 24/7. You have to teach them and counsel them that that type of behavior should not be taking place. Refusing to allow them is not going to stop them. In fact, it often makes things worse.Quote:
