How to Press Charges on a 23 Year Old Female for Kissing a 12 Year Old Male
My question involves criminal law for the state of: MS
Not sure where I need to start, but I'll go from when DHS came to my door in Feb. DHS came to my house and I wasn't there, but my 17 yr old was. He called me at work and I immed. called DHS back. DHS told me that they had an anonymous call that a 23 yr old female had kissed my 12 yr old son on the lips while he was visiting his uncle (which had a roomate). The caller waited 2 months before reporting it. They said they had already spoke to my son 3 days before, at his school. They said that my son told them "the female" kissed him on the lips before his uncle walked in. They wanted to inform me also that it was told that the female was positive for Hepatitis C. I asked her what did I need to do, she said go to the Sheriff's Dept and file a report, so I went. The Sheriff's Dept said that because it was 2 months ago when it happened and "the female" was out of state now, that there wasn't any charges I could press. Ok.... today, 3 months from when DHS called, 5/6 months from when the incident happened, I got a call at work from a person who knew about the incident, said she had been trying to find someone who knew me since it happened so she contact me. Today, I got ALL the info I needed about the female and her whereabouts. My son already told DHS what happened, there are 2 witnesses and "the female" is in a court ordered halfway house in another state for several more months. Isn't what she did illegal? Is there anything that can be done?

I haven't heard anything else from DHS. I assume it's not ongoing, esp. since they advised me to go to the Sheriff's Dept. I know it wasn't right, but I want to know if it was illegal. And what can be done?

what can be done: just what you did; file a report with the police and let them and the DA handle it from there.
is it illegal: depends on who the two people were and the intent of the kiss. Some people kiss when meeting or leaving others but I presume you meant this was with a sexual intent. If so, yes it was illegal.
I would suggest, especially since your son was interviewed, that it was found that nothing more had happened and due to the woman being removed from the situation, it does not justify chasing the woman across the state.
