    My question involves criminal law for the state of: Florida

    I need immediate help if possible. I just found out that my 13 year old daughteer has been having sex with the 17 or 18 year old neighbor. I would like to know what are the LEGAL :mad: avenues (if any) I can take? What is the age of sexual consent in Florida....I do believe it is 14 correct me if I am wrong on that. If so can I file charges? Any advice and input is greatly appreciated!!!

    You cannot file charges.

    You can, instead, call the police.

    You know your daughter has been raped. Why have you not yet called the police?

    Calling police would be filing charges, right? My question is because of her age 13 and he is 17 will that be considered consentual sex or is she not the age of consent?

    No it would not.

    Calling the police would initiate an investigation; it would be up to the DA whether or not charges would be filed.

    Your 13 year old CHILD cannot consent to sex.

    Why is this even a question?!

    It's not her question. She's a 14 year old girl doing an 18 year old adult and wants to know if it's legal.

    :mad: You my friend need to back off! I am not "doing" my 18 yr old boyfriend. I simply wanted to know when we could consent to sex.

    ginam811 if the guy is 18 then you can bring up formal charges against him. I've looked at the statues and I believe that if he is 17 and she is 13 then he is not doing anything illegal. However, in either scenario you can file a restraining order on behalf of your daughter against the perpetrator. That way if he even walks with her you can send him to jail.

    Faithdanyell14 age of consent in FL is 18. However if an individual is 16/17 he/she can consent to have sex with anyone 23 or below. I don’t know if what CourtClerk said is true. But if you are 14 and your BF is 18 and you decide to have sex, he can go to prison for up to 15 years.
