Open Visitation for Child
Our son & ex girlfriend went to court for Custody & Visitation. She was awarded sole custody and our son got open visitation. Could someone please explain the meaning of this. Somewhere we think the mother doesn't understand what sons rights are. Or thinks she doesn't have to follow them. He gets daughter for about 7 hours on Saturday ( won't discuss Sunday), and no overnights.
Please explain this to us
Re: Open Visitation for Child
Please name your state and copy word for word what is stated in his order.
Re: Open Visitation for Child
I'm sorry, NY state. He has not gotten actual papers yet from court proceedings. So I can't say word for word. Right now it basically all I stated above. They went to court on May 4th and haven't recieved typed papers yet.
Re: Open Visitation for Child
Why did he agree to open visitation?
If it's worded something like "reasonable as agreed to by both parties", he might be stuck - because if Mom doesn't agree to what he thinks is reasonable, the order is vague enough to protect her if she won't allow the visitation.
With that said, unless we know exactly how it's worded it's virtually impossible to guess.
Re: Open Visitation for Child
they went to court on May 4th. My son still has not recieved any paperwork from the court. Shouldn't he have it by now?
Re: Open Visitation for Child
What did the court tell him when he called to ask?
Re: Open Visitation for Child
We are going to the Town Court tomorrow to find out what we can as far as any paperwork is concerned. It seems that the Court House should have something that explains the difference between open and liberal visitation. I want to thank you for trying to help me. :(

Grandma:
Do everyone a favor and let your son figure this out on his own. HE needs to go to the court, HE needs to ask the questions, HE needs to get an understanding, and HE needs to do that without dragging his mommy along.
He's a big boy now. He made a baby. This is an issue between him, the mother of his child and the courts. Better you learn that now, than when you get hit with a third party interference order later because you can't learn the word boundaries.
Re: Open Visitation for Child
We went to the Court House today. He did the speaking to the Court Clerk. He still doesn't really have the difference between the 2 visitations. The exact wording is as follows.
ORDERED that the Mother ****** shall have Sole Custody of her minor Child ******: and it is further
ORDERED that the Father ***** shall have visitation with his minor child as the parties agree.
So does this mean that when she gets upset, she can literally refuse to let him have visits?
Thank You
Re: Open Visitation for Child
YES - if the parties can not agree on visitation then there is no visitation.
