    Consequences of Consensual Sexual Emails Between Employees
    My question is this, if two co-workers, who are in a sexually consensual relationship, and who are both of the same level, meaning neither has a supervisory position over the other, and they engage in sexually explicit emails with each other, can an employer bring a suit against them for this, and is it illegal? Thanks

    Are they illegal, meaning is there a statute that prohibits them? No, there isn't.

    Can an employer discipline or fire either or both employees for them anyway? You bet your boots they can. And should. That is absolutely inappropriate in the workplace, consentual or not.

    how would the employer find out?

    If they are of adult age, then can do what they want but if they do it on company time or using company equipment, the employer has every right to fire them.
