My question involves paternity law for the State of: Georgia
Can a married woman use her maiden name as her child's surname on her child's birth certificate?
Are you proposing that this would happen with her husband's permission, against his wishes, or behind his back?
Husband has left and not contacted the wife since January. Divorce action has been started but postponed because the birth is SOON. The father was in a similiar action two years ago with a girlfriend, insisted on his name on the birth certificate, and then relinquished all rights to the child. The woman's lawyer has advised her that she can legally give the name any that she choses but another lawyer said she may get in trouble with the courts. The woman would be more than willing to let the father give up all rights because of past behaviours which have come to her attention regarding abuse. Just very confused as to what to do to protect the child.
