Emancipation With Concent
I reside in Mansfield, Ohio but my dad whom has custody lives in Galion, Ohio.
hello there, i currently live with my mom although she doesnt have custody my dad does, and ive lived with her for about a year now. well i went to get a job and unfortionally i am not in school i signed out to switch schools and i never signed back into another because of the fact that my mom didnt have custody so she couldnt enroll me in the school that was in our district so i could not get a work permit there, and i am 17 i will be 18 in July and i have so much stuff that i have to pay for in june, a bahama trip, my best friends wedding which i am a maid of honor so please respond asap if you could, but anyways if i get permission from both my mother and father so therefor i wouldnt need a work permit is there any possible way of emancipation or something along those lines where i could get some sort of document saying i can work or something. also my mother is paying child support to my dad who i do NOT live with but it is court ordered because he legally has custody and the lady at that office, my social worker or whoever she is said that if i was 18 and have not graduated that she would still have to pay child support unless she got me emancipated, thats what the lady said. but thank you for your time
 Fustrated & Confused!!

Re: Emancipation With Concent
Ohio doesn't have an emancipation statute. It appears that you do have recourse through the courts under Ohio Revised Code Section 4109.06(C)(2):
Quote:
Quoting Employment of Minors - Exceptions to coverage.
(2) Any minor to whom division (C)(1) of this section does not apply may either file a petition in the juvenile court in whose jurisdiction the person resides, or apply to the superintendent or to the chief administrative officer who issued the minor's age and schooling certificate pursuant to section 3331.01 of the Revised Code, alleging the restrictions on the hours of employment described in division (D) of section 4109.07 of the Revised Code will cause a substantial hardship or are not in the minor's best interests.
If, as a result of a petition or application, the court, the superintendent, or the chief administrative officer, as appropriate, finds the minor has failed to show such restrictions will result in a substantial hardship or that the restrictions are not in the minor's best interests, the court, the superintendent, or the chief administrative officer shall uphold the restrictions. If the court, the superintendent, or the chief administrative officer finds the minor has shown the restricted hours will cause a substantial hardship or are not in the minor's best interests, the court, the superintendent, or the chief administrative officer shall establish the hours of employment for the minor and shall notify the minor and the minor's employer of those hours.
