Driveway Easement Dispute
Hello,
I live in southern Oregon and have a dispute with a neighbor over a driveway easement. I have a flag lot and own the property to the road, but my two neighbors in front of me on either side have easement rights to the paved driveway. The CC&R states that that their lots have the right to use the driveway on my property. However, I have just discovered that half of the driveway is on the property in front and to the west of me. I have no easement rights to his property and he is suggesting that he will break up the driveway (that is on his land) to give himself more yard space.
The original survey was off and the previous owners did not disclose this issue when they sold the flag lot to me. I'm in a pickle and don't know what to do. I can't affort to move the drive over ten feet.

You need to get a local attorney to help you sort out the liability here.
It could involve the surveyor, the realtor, the title company, the seller, etc.
