Missouri Hardship Hearing
My understanding is that if an injury causes a worker to lose time from work, and an employer is not paying the worker's weekly benefits, Missouri permits the worker to pursue a Motion for Hardship Setting. That involves a medical examination of the injured worker, for the purpose of determining if the worker is able to work, and whether or not the work-related accident is a substantial factor in the worker's inability to work. The motion alleges that the nonpayment of temporary benefits is resulting in hardship to the injured worker, and is submitted to the Division of Workers Compensation along with the doctor's report. A mediation is then scheduled and, if no agreement is reached at the mediation, a hearing will take place on the motion.
