    Default Not Paid for Holidays

    My question involves workers compensation law for the state of: Colorado

    I was a salaried employee and eligible for holiday pay beginning on my date of hire (per the employee handbook.) So after my boss refused to pay the holiday pay (my paychecks were smaller for weeks with holidays), I requested the company's legal department for arbitration (also, per the employee handbook.) The company refuses to respond whatsoever and it has now been six weeks. Before I take them to small claims court, is the company guilty of greater "atrocities" for not adhering to the employee handbook? Need I a lawyer?

    There is no law forcing a company to pay you for a day you did not work.

    You would file with the Department of Labor... not small claims. The DOL will tell you that you have no case.

    Wait a minute. You posted this in the Worker's Comp forum. Does this have anything to do with worker's comp?

    And, "salaried" is merely a pay method; were you exempt or nonexempt?

    (Occasionally we get posts from people who think that "workers compensation" refers to wages.)
