Your damages being what?
Damages to the car have already been settled. My doctor discharged me but I'm still experiencing pain and stiffness in the leg that was injured. Total medical bills as of now are around $3500.00
There's no formula we can hand you for calculating your damages. If you had no insurance for your medical, by all means make a claim and try to get them paid by the at fault driver's insurance. If you do and your health insurance company paid the bill, be aware that your insurance company may try to make a claim against any amount you receive from the at-fault driver to settle your claim. If you don't want to use a lawyer, start by contacting the at-fault driver's insurance adjuster and documenting your injury and losses, to see what's being offered. "Affording" a lawyer isn't an issue - if you have enough damages to merit litigation, personal injury lawyers work on contingency - their fee is a percentage of the amount they recover.
