    Default Mother Rights

    My question involves a child custody case from the State of: Missouri. My mother has been granted guardianship of my daughter until further order of the court. I was never notified of this. My daughter's father was taken to court for my mom to get guardianship. Does this mean I have no legal right to my daughter? What can I do to get my daughter back. My mother refuses to let my daughter come and visit with me.

    I dont know how my mother ended up with guardianship. I was never notified of any of this. On the missouri case net it states she is appointed guardian. My daughters father was the only one summons with paperwork for this.

    My daughter and I lived with my mother and then when I moved out my daughter stayed with my mother because I was working 2 jobs to try and support my daughter. Ever since then my mother has had her and refuses to let my daughter come visit with me.

    Ok, that's why. Kiddo was and is still living with your Mom.

    No, guardianship does't mean you've lost any rights. You're the child's legal parent. Now, because the court has obviously granted the guardianship, you'll need to go back to court to have that guardianship revoked. Have you asked your mother why she is refusing visitation?

    So if I wanted to go and get her can I legally? My mother and I don't have a very good relationship. She lost custody of all 4 of her children. She didn't have a relationship with me and my siblings for several years. When I ask her why I cant see my daughter she says because I am irresponsible. I am married and have a baby now. My husband and I have our own place and are financially stable.

    Don't bring up the fact she lost custody - you have (in the eyes of the court) decided that this is irrelevant and that she's fit to take care of your daughter.

    No, you can't just go and get your daughter. You need to go to court first to have that guardianship revoked.

    Why, if you're stable now with a new baby (which suggests it's been at least 9 months that you've been stable..right?), haven't you already gone and gotten your daughter before now?

    I didn't know what to do. I have contacted attorneys and no one has been able to help me. What are the steps of getting a guardianship revoked?

    Have you actually seen the guardianship order? Is it temporary? Permanent? When was it made?

    When you say attorneys can't help you, what exactly do you mean?

    (I don't mean to ask so many questions but there's something not quite right about your situation and I'm trying to figure out what's going on!)

    No I haven't my mother just informed me. It was decided by the court in december of 2007. I live in Indiana and my mother and daughter live in Missouri. attorneys in indiana cant help me because the case is in missouri. when I called and spoke with an attorney in missouri he told me there was nothing he could do for me.

    Ok.

    So you're saying that since Dec 07, your daughter has been living with your mother and that she was actually awarded guardianship back then, correct?

    She will have needed guardianship to have the ability to make legal decisions (schooling, medical care etc) on behalf of your daughter, seeing as neither parent was willing/able to do so. Dad was correctly served, apparently, and that's all that was needed.

    If that's the case, expect Mom - if guardianship is revoked - to file for actual custody. She actually has a lot in her favor.

    Why have you decided now, that you want your daughter to live with you?

    How old is your daughter?
