    Default How Long Does It Take to Get a Court Date

    My sister was arrested 3 weeks ago for shoplifting. She requested a trial but it has been 3 weeks and she has heard nothing. Is this normal? They said they would mail the court date but she hasn't gotten it yet... Is it possible that the charges were dropped and they didn't tell her? I ask this because a friend got a ticket and requested a trial and then never heard about it again. It has been 5 years. This is the same town as that happened in.

    She can contact the court to determine the status of the case.

    She should not expect that the charge has magically disappeared.

    Just wanted to give an update on my sister. It has been almost 2 months and she still has not received any court date or civil demand letter. She says she doesn't want to call the court for fear that it will remind them about her case and cause them to peruse the case against her more vigorously. Is this true? Do courts usually wait this long to file charges? In her case she admitted no wrong doing, she plead not guilty and she is pretty sure there is no proof other than a LP guy who said he saw her do it... personally I think its wishful thinking that this will not be perused but is there a possibility that the courts won't pursue due to lack of evidence and it being a waste of time?

    If she calls the court she will talk to a clerk. The clerk is not a prosecutor, and cannot file charges or affect the prosecution - and, besides, if she has been to court and entered a plea, there's no question but that she was charged and it's really just a matter of finding out the status of the charges. Some courts have online dockets, as well - check the website - or allow you to check an electronic docket at the courthouse.

    We can't investigate this for her, and there's really no point in our guessing about what may be happening when she can find out the actual status of her case with very little effort.

    Or she can find out the hard way.

    One day down the road even if its two years from now she will get pulled over for a traffic violation and when the officer discovers she has a warrant for her arrest she will not only be locked up but also have to pay impound and storage fees for her vehicle
