    Default Re-Entry Before a 5 Year Ban is Over

    I was given a 5 year ban last year,for living and working illegally for 10 years
    in the U.S.Now i live in Europe and will marry my american girlfriend later this
    year( who i was going to marry december 08 before getting deported).
    The ICE officers that came with me on the plane told me that because i have
    a clean record,my girlfriend can bring me back quickly and it shouldn't be a problem.I don't know if this is true or they were just B.S.
    Anyway my question is can my girlfriend bring me back before my 5 year ban,
    or i'm going to have to wait for 4 more years?

    If you've been banned, getting back into the US before the expiration of the ban is not precisely simple. Neither is it cheap.

    You would need to file for a waiver of inadmissibility. It costs $545, is 11 pages long, and is no guarantee that you will be permitted to come back early.

    But can a lawyer help speed the process?
    Money is not a problem,has it been done before?
    My girlfriend tells me that lawyers have told her that we need to
    marry first and then they will do something.
    Or will it be a waste of money?

    No, but a lawyer can make the process easier for you. S/he can help you ensure that you've filled everything out correctly and have included any necessary documentation. S/he can't make USCIS hurry up, though.

    USCIS doesn't care if you marry first, or marry later.

    Certainly, you can marry first. But you can't come back to the US unless and until your waiver is approved.

    what is needed for a waiver to be approved(there is no extreme hardship)?
    what are they looking for?

    There's no cookie cutter answer for this. You're just going to have to fill out the form and wait to see what happens. No one here can guarantee that you'll get what you want.
