    Default Time Limits on Enforcing a Judgment Lien

    My sister in-law's Dad had a judgment placed against his house and property 12 years ago due to a $10,000 credit card debt that he couldn't pay because of medical bills. He is 87 and not expected to live more than a few months, due to cancer.

    From all I can find on websites, after 10 years they can not collect on this debt in SC, which would be very large due to interest and fees accumulating.

    She is an only child and his will leaves everything to her. His only assets are his home and property. She would like to move back in to the family home. She is a widowed mother of 3 small children, and could not pay this debt.

    Her only option would be to sell the home to pay the judgment.

    Could the debt have gone away? Could/should she negotiate with the CC company before he dies?

    He needs to pull his credit reports to see if the judgement is on them. They may have renewed it for another 10 years, but if they didn't then the judgements would be gone.

    His credit report doesn't show it anymore, we have checked that. Do we need to check with the court where the judgement was filed? Should we wait?
