Here is the situation. In 1991 my wife was on public assistance; and while on it, she obtained employment, but did not let the public assistance people know. However once the overpayment reached around $6,000.00, she was contacted by the state of pennsylvania, and was informed that she owed the state $6,000.00.

At the time I also agreed to pay the money back if she could not. From that moment on the state created 2 seperate cases with different case numbers. To make a long story short, every penny has been paid back since 1996.

Instead of $6,000.00 we were paying back $12,000.00 they even put me in jail twice, while the payments were being made. It is now 2010 and the state is still saying that I still owe $800.00. I am sick of these people, and it's been over 18 years now. Every penny has been paid back, and the original case was never against me in the first place.

My question is can I sue the state of pennsylvania for failing to correct their mistake?
