    Default New Home Driveway Dispute

    State: Ohio.

    I just purchased a home in Ohio. The driveway is more or less just a parking spot between my house and the neighbors. They survey concluded my fears. The driveway is 50% on my property and 50% on theirs. The tenant that lives in the next door house (it is rented, not lived in by the owner) believes that it his to park in, since the older lady that lived in my house prior did not drive for the last 10 years. I don't want him to park on it as the driveway is paved up to my side door, and it is about 10 feet from his house. This makes it so when he parks there and gets out of his car (my house is on the left) he is able to peer right into my windows. I don't know if there would be a way to prohibit him from parking there, or if I could somehow purchase that driveway (an option I've been considering, but haven't taken action on).

    Any advice on prohibiting him from parking there, and any way of making it so I could park there?

    Did you get a title report and title insurance for your purchase?

    Were you represented by an attorney in your purchase?

    Curtains usually solve the privacy issue absent a court order.

    As far as the parking issue goes here in Ohio, it will depend on your easement documentation, which we don't have before us. If the neighbor has only an ingress egress easement, it may not provide for a provision for parking.

    A local attorney, with access to the documents not available here can advise you.

    I'm not 100% sure on everything in terms of an easement. I will just contact my attorney tomorrow, it'll be easier to have him answer some questions. I just thought I'd throw out my situation in case of there was something stupid that I'm missing.

    Since you have done a survey already you know where the boundaries are. Put a fence up on the boundary line, if its dead smack in the middle of the driveway then that will stop your neighbor from parking in the driveway. Just make sure to put the good side of the fence facing your neighbor or buy a fence that is equal on both sides.
