    Question Sexual Abuse

    My question involves injury or loss that occurred in the state of: Florida

    Hello Gentlemen

    Just a simple question>


    If i am sexual abused in the state of florida and i sue the person who commits this abuse.


    Will a judge compensate me taking away some of his money the same way like he had raped me? or i wont get anything because it's only an abuse?S

    If you win a money judgment against somebody for sexually abusing you, you can attempt to collect the money you are awarded from the defendant. Assuming nothing prevents your lawsuit (e.g., the statute of limitations) I would expect that if you successfully prove to a judge or jury that you were sexually abused, you will receive a money judgment. The amount will depend upon the facts of the case and how well it's presented in court.

    If the person who abused you is charged and convicted, you will have a very good civil case.

    If the person has not been convicted, or worse, not even charged, then you will have a real uphill struggle to win in civil court. I doubt you will find a lawyer in Florida who will take a civil abuse case without a criminal conviction or at least a charge.

    If the abuse is institutional, that is a different matter and a crimnal prosecution is not as important.

    If the abuse is institutional, chances are the facility has insurance, so it would be much easier to collect (or they might settle before trial) then it would be to collect from an individual.

    An individual homeowner's policy or business policy does NOT usually cover any intentional torts.

    If you think an attorney is going to do an investigation as the police would do, it will not happen.

    You need to report the abuse to the proper authorities immediately if you have not already done so. Otherwise you will have no credibility in a civil trial, though I am confident you will never get that far.
