    Default Neighbor Built New Fence on My Property Blocking My Sprinkler Heads

    State= Florida,Co= Pasco, Town = Lutz.

    A neighbor built a new fence on my property. It is a rental so not sure exactly when he built it but was within the last year. I just noticed it as it blocks my sprinkler heads, which were installed correctly when my house was originally built (before his house was built). As a simple solution I asked him to move my sprinkler to my side of his fence and he refused and then I asked him to move his fence back to his property and he refused stating that he did not THINK it was on my property. Neither of us has a new survey showing the fence, but since it blocks my sprinklers I am sure it is on my property.

    Other than blocking my sprinklers are there any possible legal problems with his fence being on my property, such as, impacting any future sale of my house?
    How do I get him to move his fence and what are the steps I should take (letters? emails? pay for new survey as proof? etc). Since the fence is on my property do I have the right to tear it down and legally, do I have to notify him first?

    Suggestions on how to handle this as quickly as possible?

    how do you know our sprinklers were not installed on their property?

    Without a survey, you have absolutely no support for your claim so the first thing you need to do is get a survey.

    then once you have that knowledge, you can deal with what ever is shown to be the property line.


    If you tear down the fence and you are wrong about the property line, not only would you be liable for all the damages, there actually could be criminal charges (unlikely but possible).

    My original survey shows the sprinkler heads are on my property. I do not have a NEW survey showing his fence.

    and when you say original survey, was this a boundary survey with stakes in the ground and all or a simple mortgage survey when you bought the property?

    are there still stakes or pins in the ground that you can locate?
