    Unhappy Reapplying for Custody

    My question involves guardianship in the State of: Virginia
    Yesterday was the hardest day of our lives. We gave up parental rights
    to our 15 year old daughter. I will not go into details as to way but it was bad situation. Her step sister ,age 20, is trying to get custody which will not happen i have been told due to the step sisters condition. My daughter put all her eggs in this basket.
    The question I have is if over some time that we start to reconcile and she is still in the foster care program, can we apply for custodialship of her all
    over?

    Were your parental rights terminated? Or was custody given to CPS?

    Is your daughter mentally ill? Was this done to keep her or the family safe? to get services?

    You're going to need to give at least some details if you want accurate information - sorry, but there are so many variables that it's impossible to really answer without asking some questions!

    What's the step sister's condition?

    Is this a CPS/DHS matter?

    Thanks for the response.
    As far as the half sister, she is 20 has 2 kids not married, part time
    at a dept store and facebook full of her drinking under age out at bars.
    As far as my daughter.
    In Jan she accuse me of abusing her which later in court was unfounded.
    She has a terrible prob. with authority and rules.
    The family, at this time, believes it was our best interest to proceed this way.
    The custody hearing for her with her half sister is this mon. and would
    be shocked if she were givin custody.
    We are holding out hope for the future but it depends on her.

    I forgot to mention that this was a DSS matter and we voluntarly relinquished the rights.

    Generally, DSS doesn't take parental rights away as the first step in these situations, they take custody.

    Assuming they have taken custody (and not TPR), then you should have a reunification plan that would include a significant number of goals for your daughter and some for you as well. Once the goals were met and it was determined that she could safely be returned to your custody, that could happen.

    If they really terminated your parental rights, then there will not be any plans to reunify and, legally, she is no longer your daughter.

    They did orig. did take custody and we voluntary terminated parental rights.
    The issue we are having is if by some chance, slim chance that there can be some kind of reconciliation in the future can we submit for custody of her.
    Just like starting over.
    My other concern is here half sister and her chances after the circumstances
    I described above.
