Default Equity in Home Purchased Before Marriage

My fiance' is divorced but the property settlement is ongoing.
Shortly before their wedding, they purchased a home together(both names are on the mortgage and mortgage payments were made from a joint account for two years).
Now, her ex-husband insists that he is keeping the home and that he owes her nothing in terms of equity b/c he made the down payment on the home with his own money.
Is she entitled to any ownership in this property?

Default Re: Equity in Home Purchased Before Marriage

The law will vary by state, but normally the increase in equity would be a marital asset subject to division.
