    Default FMLA and Intermittent Leave

    I have a medical certification on file for intermittent leave for migraines.


    Does that mean that everytime I have a headache I can call in sick and use intermittent leave up to the 12 weeks (84 days)?


    I also think that if I call in for a headache they can't charge it against our attendance policy where there is a point system and I would normally get charged 1 pt.


    Can they ask me for a Drs note each time I call in sick with my headaches or is the medical certification on file good for the whole year?

    Is that what your medical certification states?

    An employer cannot impose restrictions for notification and attendance which are more restricive than those of the FMLA.

    An employer is
    generally permitted to request recertification of an employee's need for intermittent leave at least once every 30 days.
