Ok- So I had a car that broke down in mid November of last year. It still ran, (just not for long periods of time) was plated legally and insured. I got a new car and since water was put in the radiator i decided to wait until the spring to sell it. In January a note was put on it saying it needed to me moved to aide in snow removal (I live in an apartment complex). I moved it (pushed it) and it was fine. About a month ago another note was put on it saying if it wasnt moved or it the tire wasnt inflated (it got a flat, rim leak) it would be towed. I called the apartment complex and they said I had until the end of the next week to sell it (i couldnt get the tire off, it was rusted on). i got another note on the car that said it would be towed on 1/4/10 thursday if it wasn't moved. i ignored the note, because it was 3/29 and i was planing on having someone come get it the next day (today). well today they towed it, two days before the note said they would. i called the apartment complex and found out where they towed it. i called budget towing and they said it would cost 225$ to get it out, and even if i got it out i would have to get it towed (because of the flat) so add mileage and the fact that i have no where to bring it. so i went there with the title with the intention of just selling it to them (hopefully for the price of the impound fee) and just calling it even, and absorbing the loss. i was only gonna sell the car for $300 anyway. they told me i would still have to pay the fee, but i'd get like 20 bucks knocked off if i gave them the title. i went there and talked to the owner and he said i could pay 75$ and give them the title and i would be all set. i thought i was getting a deal. i thought i was gonna have to pay around 180$ so i said sure. i went to the back to empty the car out and saw the note still on the car and it said "your car will be towed on thursday 4/1/10". i asked them about it, and they said that in the notes section of the note it says "call your office by 3/30". but it also said your car will be towed on 1/4/10. i couldn't call the office because i was at work all day. i just thought since it said "your car will be town ON 1/4/10" i had until then to remove it.
all of this happened so fast, and i just wanted the issue to be resolved because its an extra 20 bucks a day at the impound lot. did they screw me over? if its my fault that i completely wiffed on the "notes" section of the note to call the office then i will take it up the tailpipe. but the note clearly stated they will tow on 1/4/10.. and they towed it early. i didn't talk to my complex about this, because they were closing and could only tell me where the car was. some people are saying i was severely screwed and could sue the apartment complex for the bluebook value of the car. this may only be moot because i already signed the car over to the impound lot. any insight, however, would be appreciated.
