    Default What Happens if an 18 Year Old Mother Marries Baby's Daddy

    My question involves criminal law for the state of: Texas

    When an 18 year old marries her baby's 28 yr old daddy, will they be protected from stat rape charges from parents who denied the marriage before while she was a minor?

    When a person turns 18 years old, they become an adult. They may then marry anyone they wish. Your turning 18 does not remove the liability of a person having had sex with you as a minor. But the age of consent in Texas is 17. As long as you were 17 when the sex took place, he will not be charged. If you have already married him, your parents cannot undo the marriage. If you got pregnant before you turned 17, he can still be charged. Whether he will be would be up to a prosecutor after someone reports it. It is time you have a frank talk with your parents about your future as you see it.
