Emancipation in New Jersey

I am currently 14 and living in New Jersey. I really want to know what age i can move out at. I hate living with my parents. They don't let me go out as much as I want and they are way too concerned about my saftey. If anyone knows the earliest age i can move out at with all the procedures please tell me. Also any other possibilties I can take in order to get what I want. Thanks[/code]

New Jersey has no general emancipation statute. It does have an emancipation statute for minors with HIV, but that's a very limited statute. There is some common law authority in support of emancipation, but it's more a description of when a court might deem a minor to be emancipated as opposed to how that might be achieved, although it makes plain that active duty military service results in emancipation. See Bishop v Bishop, 287 NJ Super. 593, 597, 604 (Chan. Div. 1995) (because the mother was no longer fulfilling her son's "material requirements, such as food, housing, and medical care" and "relinquished any remaining control and responsibility over her son" by virtue of the son's enrollment at West Point, the father was held to be relieved from his support obligations for the child.)

No state but California will even consider emancipating a 14 year old and for a 14 year old to be emancipated there, you need to be either a successful child actor or a nationally recognized sports figure, and even if you are it's not guaranteed.

I will tell you right now, even if NJ would emancipate a 14 year old there is no way a judge would see "My parents are too concerned with my safety and don't let me go out as much as I want" as a reason for emancipation. A judge would be much more likely to see that as an example of good parenting and congratulate your parents on the good job they're doing.

My friend is 17 and wishes to be emancipated. His parents wish to move to Louisiana, but that is not the main reason for emancipation. His parents are...let us say unethical about the treatment of their son.
He would not be living on his own, he plans on moving in with me. Does this effect emancipation and if so, how? Please help!

Yes, it affects emancipation. If he is not paying for all his own rent, food, clothing, utilities, transportation, medical care, insurance, school fees and supplies, and can continue to pay for all of his own support if you (or your parents) kick him out, get hit by a bus en masse, or get transferred to New Zealand and cannot take him along, then he cannot be emancipated.

Emancipation does not mean moving in with someone else. Emancipation means supporting yourself.
