    Default Concealment of the Whereabouts of the Minor Child

    In February I offered to the minority timeshare parent the chance to legally keep the minor child in the home state of Florida while I left for California. That parent refused to sign any agreements, and additionally withheld the current address where the minor child lives during the exercise of minority timeshare. I arranged to have the minor child reside with a grandmother during my absence, as I had already planned to move back into her home once my lease ended in February. The minority timeshare parent said "since... [I was] going to be gone a couple of weeks... [the minor child] should probably stay with [the minority timeshare parent]..."

    The minority timeshare parent has, since March 6th, proceeded to take full-time responsibility of the minor child. I thought-- at first-- that this parent was withholding the location of the current address just to make it difficult to serve legal papers or keep me from "starting trouble." (This parent tends to say I'm going to start trouble... insisting for all of our interactions to occur at my home, a grandparent's home, or public places except once in 2006 where I dropped off the minor child at the home of the minority timeshare parent.) However, this parent has not answered or returned any of my calls and text messages.

    On February 25th, I filed a Motion for Contempt to Compel Disclosure of the whereabouts of the minor child. I have left multiple voicemail messages with Family Law Services since March 3rd. I'm starting to worry. Should I have done more?

    Does the minor child attend school? You could pick the child up from school.

    She attends school, but I'm three thousand miles away from her right now. My trip ends on March 30th (It was only from March 1st to the 30th.) Should I just ignore the situation until then?

    Okay, I'm freaking out a little. I e-mailed the teacher yesterday, and she just got back to me that our child hasn't been in school all week! I tried calling the other parent & it went directly to voicemail like it's been doing for over a week. So, I sent a text message:

    "Hi, just checking in! [our kid]'s teacher said she hasn't been in school. Is she sick? Just let me know ASAP. I don't want to overreact and call the police or anything if everything's okay. Okay? Thanks!"

    We've been really friendly for the last couple of years. Except for this address thing, we haven't had a single issue with each other since the divorce ended two years ago. I did recently get engaged to someone who has relocated to California (my reason for the trip I'm on right now). I'm just scared.

    What do I do?

    As soon as you get back, go to the courthouse and get a date set for the contempt hearing.

    It's 12 days until the courthouse opens after I return late on the 30th. I left another message on my coordinator's machine, but got the same outgoing message that due to the volume of requests, it takes a minimum of 15 days to return a call. It's been over 15 days. The other parent hasn't talked to me since February 25th.

    I offered him the chance to keep her, all he had to do was sign a document and fill out the part that asked for his address. He didn't want to; he said he'd first have to get a lawyer to look it over. He responded to one of my text messages on March 3rd, when I sent my temporary address so he could serve papers on me if he wanted to. I looked on our public records online.

    He's filed for Sole Custody, Modification of Visitation, Modification of Child Support, and Objection to Relocation. I never got those. He must have sent them to my apartment even though I told him on the 26th of February that my lease ended that month. I followed up with the text on the 3rd saying what my new address was.

    He filed all these on March 9th. I haven't even relocated with our daughter. He knows I want to, we discussed it, but I was going to leave her with him while I decided. He just didn't want to do that, because he didn't want to sign anything.

    So I arranged to have our daughter's grandmother look after her while I was away. He then arranged with the grandmother, on March 6th, without talking to me, to hand the daughter over to him. What do I do??? We've gotten along really well.

    The finalization of our divorce reached its 2 year anniversary last Saturday. He stopped paying child support in September of 2008 & I haven't taken any legal action, just gave him extra time. My daughter's teacher says she's not been in school and now I don't know where she is. Her dad isn't returning my phone calls or text messages.

    This feels surreal. I get along well with his girlfriend. I know he's living with her; she's pregnant, due any day now. I'm suddenly realizing that I know nothing about her except that she'd nice, pretty and fun to have at a child's birthday party-- not her last name, address number, nothing!

    We've gotten along so well. He's a really great dad. Even when we discussed moving, I said I wanted for him to have all of Winter, Spring, and Summer Vacation every year-- and I'd pay for it. I thought it was sweet that he didn't think that would be enough time for either of us... that I'd only see her while she was in school & miss out on vacations and he'd get less time with her overall and not be a part of her school except over the webcam.

    I don't know what to do!!! This could all be a misunderstanding, right??? We've gotten along so well! I just want to do the right thing, but I feel so insane, like I don't know what that is!!!
