    Default Shoplifting at Walmart, Minor, Misdemeanor Class C

    My question involves criminal law for the state of: Texas

    These past few weeks have been terrible for me, this entire incident has kept me depressed for quite a while. I have no idea what is going on in my situation and i really need to know what lies ahead for me in the future.

    Story:
    I am a minor (16) who was caught shoplifting in a Walmart in Texas. The total amount stolen was under $50 so it is considered a Class C misdemeanor, and i was not arrested. While i was at Walmart, they told me that i can no longer go to any Walmart for the rest of my life, yet they never took a picture of me. I have to appear in court. A few days later, i received a letter from Walmart saying that i have to pay a fine ($150,000). So far my parents have not yet recieved anything pertaining to me being banned from Walmart, although i have already told them.

    I know what i did was wrong and it was a stupid decision on my part. I will become a law abiding citizen and will never attempt anything like this ever again. I am a student with good grades who wants to go to college. I have several questions that remain unanswered that I hope someone will answer.

    Questions:

    Do colleges in Texas look at juvenile records?
    On a college application do they ask me about my criminal record?
    What is the quickest way i can have this entire thing sealed/expunged?
    Am I still banned from Walmart, even though no paperwork or contact has been given to my parents?
    If an educational institution looks up my background, will they be able to find the full details on me or will they just see "Misdemeanor Class C"?

    Um..your fine was not $150,000. Probably more like $150.00.

    Your questions:

    They may.

    On a college application do they ask me about my criminal record?
    From what a lot of people have posted, yes. And especially for certain programs like Criminal Justice, Banking...anything that involves money or a high level of trust. Even a Real Estate Salesperson Application will ask. So will many job applications, including retail.

    What is the quickest way i can have this entire thing sealed/expunged? Best have your parents talk to a lawyer about a Diversion Program.

    Am I still banned from Walmart, even though no paperwork or contact has been given to my parents? YES. Do not go into a WalMart or even a Sam's Club. You can be arrested and charged with Criminal Trespass. You can write them - once you have a job and regular income - write the Corporate Office and ask for permission. Make sure it comes in writing.

    If an educational institution looks up my background, will they be able to find the full details on me or will they just see "Misdemeanor Class C"?
    I don't know what it will show - but even Misdemeanor Class C will tell them you did something wrong, and they may want details. I applied for a Florida Real Estate Salesperson license, and had to provide Certified Copy of Judgment, explanation of the charge, and letters of recommendation from former employers and friends.

    What is a diversion program?

    For a diversion program, can the court sentence me to a diversion program, or does a diversion program need to be asked for first?

    I’m a little confused, did the Police show up….or not?

    If they did, I’m guessing you were issued a summons?

    Did you sign a criminal trespass notice?

    The police showed up, but i was not arrested and taken to jail. Yes i was given a summons, and yes i signed a criminal trespass notice, even though they never took a picture of me and my parents were never notified of this.

    Wal-Mart has a zero tolerance policy towards shoplifters, if you signed a criminal trespass notice, you can be arrested on sight once you step foot inside ANY Wal-Mart or SAM’s club.

    A criminal trespass for Wal-Mart inc. lasts forever. Although you may petition Bentonville to have it removed…I’ve never seen it done.

    As a matter of policy every Asset Protection (LP) office is required to be monitored by CCTV. Did you notice the little black ball on the ceiling? They don’t need to take your picture, because they already have it.

    After you departed the store, Asset Protection Associates started a case file and entered your information into a central data base called APIS. Then they shared the information with every other Wal-Mart/SAM’s store in the nation.

    Now with that being said….will they actively “hunt you down” if you go shopping at Wally World again? Probably not….but I wouldn’t use a check, debit card, credit card or anything else with your name in the store. And if anyone recognizes you, it could get ugly real quick.

    In short….if you go shopping at Wal-Mart again, you’re rolling dice….and sooner or later it’ll come up craps!

    And just to stress what Criminal Trespass means....

    You step into WalMart. Someone recognizes you.

    - You would be detained in the LP office.
    - Police would come. This time, you would most likely NOT be issued a summons and released at the scene. Don't be surprised if a pair of pretty silver bracelets were placed on your wrists, and you were escorted out of the store to a waiting police car. Then taken to the station, have to post a bond...

    Get how serious it is?
