    Default Publishing Photographs

    A dozen inmates of a local prison are staging a roof-top protest. They are displaying a large banner which reads:

    “Stop brutality by governor and staff of D wing”

    A newspaper publishes a photograph of the protesting prisoners and their banner.

    What could be possible legal pitfalls?

    Legal pitfalls for whom? The press?

    None. They have the right - and duty - to report the news. This is news. They're reporting it, as is provided for by the First Amendment.

    The prisoners? None. The same amendment protects their right to protest and to voice their opinions.

    Yes for the press.

    Could the prison not sue for defamation of character?
    Would the newspaper be allowed to print the names of the prisoners?

    since this is obviously for classwork, how about you answer your own question.


    Explain how printing a pic of people intentionally holding up a banner suggesting they are being treated improperly would be considered defamatory. Who is being defamed and how?

    There are so many protections for the media in statute and case law, one would have to be extremely inept and uninformed on media law to even think the prison has any legal recourse. In addition, I have never ever heard of a prison suing or even having standing to sue the media for defamation.

    What hole did you dig in to come up with this post?
