Roofer Gave Me No Warranty

My question involves a consumer law issue in the State of: NJ

My roofer told me he'd give me 10 yr. warranty on the roof (labor) and that the roofing product had a 30 yr. warranty. He flipped out during the job because he wanted me to pay cash & I said no (as if I had $4000 cash).

Afterwards, I never received the warranty documents. They left a mess in my attic and I have reason to believe they did something wrong but there havent been any leaks. I now have mice up in the attic (never had before). How do i get them to give me the warranties..I do have his estimate with the 10 years written on it (it will be 2 years in 8/2010 that the roof was installed). Do I have a statutory time limit on filing suit?

First, you would have to establish that the roofer actually did something wrong. Your belief, or even the presence of rodents, isn't going to suffice. Rodents will normally enter a space from the ground up, or if your house is connected to another from attic to attic. Call an exterminator, find out how they got in, and get them cleaned out.

It doesn't seem likely that they're going to hand you a new document stating that you have a ten year warranty, so if you do take them to court you'll probably need to rely on the estimate.
