Police Department Never Filed a DUI Complaint

I got into an accident (nobody else involved) and was charged with a DUI. When i showed up for court, they told me that the police department never filed against me (yet) and i have to keep checking back to see if they ever do. So far they haven't and its been a while now. My question is, can i get my license back? I don't think the cops that arrested me are ever gonna file against me because they seemed real sympathetic when they took me in and knew that i realized my mistake and i wasn't sloppy drunk or anything.

i was took in early January 06...so almost 5 months..my court date was in march though. Is being late or not filing a complaint at all for a 2nd DUI charge common?
