    Default Alabama Common Law Marriage

    My question involves marriage law for the State of: Alabama. My wifee and I were married 14 years before legally divorcing in the state of Alabama. After the settlement she and I began seeing each other again and 4 months after the divorce I sold my home and moved in with her and my children in a home she purchased.That was 2 years ago and 2 months ago we started having problems and she made me leave her home as she put it. We purchased a home for resale purposes together although the loan was in her name we sign a quit claim deed and entered both names and I paid money down out of pocket. Home was later sold and we never lived in it. I also purchased her a vehicle and paid cash for it but the vehicle is titled in both our names (john & Jan Doe), she still drives this car today. We also introduced ourselves as husband & wife, she was on my health & auto insurance.Are we married in Alabama?

    Sorry I wasn't finished and couldn't edit the original question. Anyway, I'm almost certain that I am considered common law married in the state I reside in. Once I confirm this, what should I do as far as legal issues go to be recognized as married? Since common law is basically the same as a ceremony wedding and requires divorce my guess is adultery and all other state marriage laws would be recognized as well?

    Depends - during the past two years were you filing taxes together as married? Holding yourselves out to be a married couple?

    Yes in fact we both had introduced ourselves to co workers and others as husband & wife. As for taxes, I'm unsure, will need to pull my returnsto find out for sure. Thanks for the reply.
