    Unhappy Minor Not Allowed to Travel Out of State

    My question involves guardianship in the State of: Illinois and Pennsylvania.

    My Fiancee lives in Illinois. But I live in Pennsylvania. He currently does not live with his mother for months, and lives with his grandmother. We had plans for him to visit me during my winter break from college. His mother already said yes before but decided to change her mind today, 3 days before he leaves on the train for this reason 'I don't want you to be happy'. So she took away his consent. With him living with his grandmother and having no contact with his mother can she keep him from me? If his grandmother says yes he can still come without his mother's say? Or is there a way for him to be emancipated without his mother being involved? We are due to be married THIS Saturday! I don't want my wedding called off!

    If he is a minor, then he lives where his legal guardian says he lives, and he does not travel out of state, or even in state, without her permission. End of discussion. His legal guardian is his mother unless a court has specifically said that it is someone else. It doesn't matter who he is living with.

    No, he cannot be emancipated (particularly not before Saturday) without his mother being involved. If his mother objects, he will not be emancipated at all. Nor does he meet the requirements for emancipation in Illinois - he is not homeless, he is not living on his own separate from his parents/guardian, he is not managing his own financial affairs.

    She, as his legal guardian, can do whatever she pleases with him until he reaches the legal age of majority, whether it suits you or not. She can forbid him from seeing you, talking to you on the phone, or even sending you e-mail.

    She can slap you with a restraining order if she so desires.

    I don't for an instant believe that he had parental consent to marry. The state of Pennsylvania requires written permission from the legal guardian to marry before the age of 18. I call shenanigans.

    Contact your guests. The wedding is not happening.

    It makes my teeth itch when people think they're going to get all high-falutin' and fancy pants and use the French word for "my intended"...and use the wrong damned one. French is a gendered language. If you're going to use the language, use the correct gender or STFU.

    My teeth get itchier still when it's teenagers using the words - correctly or incorrectly. I would knock my son into the next century if he referred to his girlfriend as his fiancee. I don't want to hear that word til they're both old enough to drink.

    Gosh I feel your pain. I went to school in England and by my final year had suffered through four years of French, three of German and two of Latin (you can see how that works, right?).

    I still have nightmares about my Latin verb endings; -bam, -bas, -bat, -bamus, -batis, -bant....

    OK now I really need to hit the champagne

    (and I'd ditto the "son and girlfriend" thing, except my Skids are already...well...one is married with two kids, the other is a single Mom. Both had their "fiances" by the time they hit 18....)

    Dogmatique, when you come out to visit me, my DH is going to love you; he doesn't have anyone to speak Latin with. He's one of six people in the country who actually remembers what he learned in Latin class; it was too much to hope that you were another of the six!

    Excuse you? But uh... first of all I was typing awfully fast for I needed to help cook dinner. And second...I AM FRENCH and can SPEAK FRENCH!

    No...I meant she took away his consent to actually come visit me. Our wedding was completely secret, no guests or anything. Just between me and him. The reason why, I don't believe in the whole liscense thing....quite yet. We'll have that wedding in 2014 on Halloween. Marriage lisence and preists are disgustingly Christian and Catholic. We're both Pagans ( for those of who who have no clue what that means it means we're witches). So we were doing a Handfasting Wedding.

    Well, you're going to have to wait until you're both legal adults.

    And if you spoke French as well as you claim, you wouldn't have made such a basic mistake. So calm down, little girl, and try to behave like a grownup.
