    Default Who can use Right of Way - Paving ROW and Parking

    I'm having trouble finding info on ROW. An agravating neighboor behind me has a 50 foot right of way across my property by deed.

    Do I have to allow anyone he wants to to use it? Can I limit the use to He and his wife?

    It is a gravel road at the moment. Can I stop him from paving it if he so chooses?

    How can I get him and his users to slow down. My wife and kids walk along the road.

    Does his ROW allow him and his guests to park their vehicles on the Row?

    His rights depend upon the laws of your state, and also the terms of the grant within the deed.

    Typically the holder of the right-of-way can maintain it, but cannot improve it. Paving would be an improvement.
    Also a "right of way" by definition is a means of ingress and egress, not extra parking space. (But again, your respective rights could vary depending upon the terms of the grant and state law.)
