Apparently, under South Carolina law, you would be entitled to be appointed as the estate's personal representative if others did not qualify to be appointed or declined to be appointed (like, say, the person nominated in the will).
You are being asked to waive any right you have to serve as personal representative and assent to someone else being appointed - the someone presumably named in the form. You are also being asked to consent to that person serving as personal representative without posting a bond.
If I give up this right it will go to my stepmother. (I am my biological parent's only child.) She will not share what is in the will with me. Will probate court take care of distributing what was left to me? Or because she will be representative, will I be giving up what was left to me because she will distribute as she pleases? The personal representative must follow the law and the provisions of the will.
