    Default Simple Assault - Dismissal of Charge

    Tennessee

    I was recently the defendant in a case, where we were both cited for simple assault. The court ruled to hold the case for 6 months, and pending no further problems during that time, to dismiss the charge.

    My question, is this, what exactly does a dismissal of the charge mean? How will this show on a background check? Is this something that can be exponged off? Also, I am in nursing school, will this prevent me from being able to work as a nurse?

    The plaintiff, admits in the police report that she assaulted me first, but claimed that after hitting me, a fight ensued. So, she wanted me arrested for assault. The officer did not arrest either one of us, just gave us citations for simple assault. Seeing as how I did nothing wrong here, I am now concerned about how this will affect my job employment options in the future.

    Any help would be greatly appreciated. Thanks.

    When the charge is dismissed, that's usually what shows up on the record - the charge with a disposition of "dismissed". As it would not be a conviction, I doubt that it will affect your nursing career. Talk to an advisor in your program. Tennessee's expungement law is quoted in this thread.
