Wrong Date on Ticket for Unsafe Lange Change / Failure to Signal

My question involves a traffic ticket from the state of: Washington

I was stopped on 5feb10, and both dates on the Notice of Infraction state 4/5/10.

I know that IRLJ 2.1 requires that the correct date must be listed on my copy, but that IRLJ 3.1 pretty much makes that not matter as long as it doesn't prejudice my substantial rights.

I guess my question is does the date being 2 months in the future prejudice my substantial rights? Is there anything else for me to consider?

The issue may be that your copy of the ticket isn't clear; I am skeptical that the officer would accidentally mark "4" instead of "2".

Are all of your tickets partially illegible?

It is very very legible. There is no mistaking it for anything else. Both areas obviously say 4/5/10.

Just to put the information here so people have it.

I hired a lawyer in the Seattle area to fight this ticket. The ticket DOES have to have the correct date on it. The lawyer said that some judges in King county will try to roll you over and let the ticket go through, but as long as you advocate very strongly for yourself, it must be dismissed. The notice of infraction is very clearly worded as is IRLJ 2.1

The officer certifies under penalty of perjury that the date they put is correct.

I will post back when the case is done with the results.
