    Default Collecting Child Support

    My stepson's getting into every trouble he could think of to get out of our house and live with his Mom. My husband put up with all his disrespectfulness and disregard to everyone in the house for a long time and now he decided he'll send his son to the mother. Now, the mother, threatened my husband that if he tries to send my stepson to her, she'll persuade my stepdaughter to live with her too--obviously because she wanted to collect support.
    The kids (daughter,15; son,12) lives with my husband since the mother give up custody to my husband in 1997. They had an agreement that she would give the kids to my husband so long as he don't collect support from her but in that agreement said that that stipulation is subject to change.
    So, my question is--can my husband demand a support from her? And, if both kids live with their Mom, how much would be the percentage of that from my husband's income? My husband get paid only $10/hour and he we have a 2 year old too.

    If the children live with your husband, he can request child support. If they live with their mother, she can request child support. Child support is normally determined in accord with the child support guidelines of the state which issued the custody order. You can review the Florida child support guidelines here.

    Default custody granted in another state

    I forgot to mention that the custody was granted when my husband was still in Illinois. We're planning to move in North Carolina and the son will stay with his mom here in Florida. So, what law would govern the child support issues?

    Ordinarily, the laws of the state which issued the support order.
