Default What Assets Are Subject to Judgement Collection
State is WV

I went to a truck driving school for 4 days found out they where scamming me by charging me over 2000 for 2 weeks of classes. I took a student loan out for 2000 and only stayed 4 days and left. I never received any money and I told the school I wanted to work a deal for the 4 days and never heard from them again.

9 years and 7 months later just 5 months before sol I'm going to magistrate court on a judgment case and they're seeking $3995. Of course this is a debt bought by a lawyer from the school for pennies on the dollar I'm sure.

They reason I left the school was that I felt it was a scam. The first day I get there they have us change or license to Kentucky because that's where the school is, the second day they give us all the answers to the CDL permit test so we didn't learn anything there. They were in bed with one of the DMV officials. But I did get 100% lol. They also talked us into signing with a carrier that promised to pay our school if we promised to work for little pay for 1 year. So little it started looking like indentured servitude.

They next day they take about 50 of us and stick us in a dirt field with two old beat up trucks and told us to practice baking up etc and were teaching us a little about how to pre inspect the truck to pass the driving part. But told us not to worry to much because everyone passes. It was 90+ degrees and all there was for shelter was an 30+ year old trailer with missing windows no ac and warm water to drink. Despite this I decided to tough it out for a little while. I finally get my turn in the truck and I was jerking it a little bit and the one of 2 instructors start ridiculing me. To me this was the last straw I went back to the hotel packed and went home.

I receive SSI and I'm disabled

Me and my wife are allowed one car that's exempt and one house payment lol. Other than that we are only allowed to have 3000 in assets for I to still collect the SSI. We live pay check to pay check and very seldom have much if any funds in our accounts.

My wife has a mini van that she's lopsided on that's not counted as an asset by SSI because of it being lopsided. I'm half owner of a 2000 Mustang GT I claim this with SSI as my only car so I'm allowed to have it.

It is owned by my mother and I. It's in her name first the word and then my name. Like Betty Jones and Billy Jones. If I lose the case can they seize this car to satisfy the judgment? I heard since it has and between the names instead of or it takes both are signatures to sell. Could they seize her half?

I'm more than willing to make payment on the 4 days worth of school but other than that feel I do not owe them the rest. One peice of the loan agreement is filled out by some lady. I can tell by the hand writing says I asked for 5800 but only recieved 2 and I have never seen it before. Or does it have any of my initails or sig. The only page they have with my sig is something that has no amounts on it?

Cliff notes:

If there's 2 names on an auto title and it says Bob & Joe instead of Bob or Joe. If Joe owes a judgement can the car be siezed for collection if Bob objects.
