Default Wet reckless on a background check
I pleaded no contest to a wet wreckless charge back in sept. of 2005, now i'm going to be promoted at my job and a requirement is a background check. Will this wet wreckless show up in my record?

A "wet reckless" driving conviction in California is a criminal misdemeanor, and thus it very well could show up as part of a background check.

So if a criminal background check was to be made, the "wet reckless" would show up? I tried to do some research of my own and i read somewhere in the defenition of a "wet reckless" that it gives no record of a drunk driving conviction. Am i right or wrong? please say i'm right :?

A "wet reckless" is a reckless driving conviction that can be used as a prior offense in the event of a future drunk driving conviction. It won't otherwise show up as a drunk driving conviction, as it is a reckless driving conviction.

Okay ... there is no such animal as a universal and generic, "background check." A background check can be as simple as asking you if the information presented is true, or as complex as investigators personally visiting references, employers, and actively seeking out law enforcement contacts and arrests. What your prospective employer will check is anyone's guess. Plus, this is likely also on your DMV record for 7 years ... so if the job requires a DMV printout, it will show up there as well.

A private employer could not access you state criminal offender record (in CA, anyway) but they COULD contact the court and obtain any public records involving court cases you were a part of. These records can be held for up to 7 years. Plus, there are on-line background firms that will search these public records for a fee.

So, there is no way anyone can predict WHAT a background check will find.

i see. so there's no way my employer (pizza hut) could have acess to my criminal record.

Not from the state of CA.

But, they COULD get your DMV printout which would have that information ... and they COULD request public records from the courthouse that might include this information.
