Default How to Get License Suspension Credit After Discarding Duplicate License

My question involves a driver's license issued by the State of: PA

Hi, I had lost my original license prior to the suspension and obtained a duplicate. I had recovered my original license and discarded the duplicate in the trash. In October of 2008 I had a DUI conviction and had to surrender my license(the original) to the police department. They had sent it in to PennDot so I would recieve credit for the suspension. I had recently contacted PennDot to send in restoration paperwork, but they had told me I did not recieve credit because they did not have my duplicate in their possession. My question would be, is there anyway for them to credit my suspension if they had the only copy of my license even though I did not have the duplicate in my possession to send to them?

See, your problem is that the moment you got a new license, the old one was invalid.

Therefore, you threw away the wrong license.

I am aware of this now. That still doesn't answer my question.

yes, if they want to but it appears they apparently don't want to.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

"They" meaning the person who I talked to who is a customer service representative, or should I speak to a supervisor/manager?

There are ways of getting back credit, and almost none of them are calling PennDOT and asking for it.

    1st some fun facts.....
When you had your license suspended you received a letter asking specifically for ALL license products. It even states on this letter to turn in any duplicate licenses, camera cards, and motorcycle permits. If you can not turn in any of those products for any reason it directs you to fill out form DL16. (it sounds like you already did that, but if you need the form just ask)

Going back a year to when they took the license from you in court, what did you do after that time? Did you get a NON-Driver ID card (photo ID)? Did you move? If you moved did you update your address with PennDOT?
Have there been any violations (tickets) since the DUI?

Answering the above questions will make it easier for me to guide you if you have a chance of getting credit.

You can try writing to PennDOT and asking for credit to be granted because you absolutely knew about the suspension. (probably won't work)

You can request an administrative hearing and request it then. Admin Hearing Fact Sheet

You do NOT want to go there on your own.If you don't know what you are doing they will kick you out very quickly.

Other than that you can look into a Work License if it was your first DUI and there were no other disqualifying violations.

    Good Luck,

I didnt have the duplicate in my possession.

NO, the very first step is to complete the DL16 to get started. Get it DL16

You stated above that you did get a non driver photo ID but you never moved or changed your address. It is possible to get credit, I would look into professional help, I think you have a chance. There are a ton of other factors but you basically want to find some communication with the department after the suspension started and they did not tell you your credit has not begun yet.

Consult with a professional and let them pull all the records. They will ask you a ton of questions about what was said in court, and they may even pull the transcripts from your hearing. They will get a ton of things from the DOT to try and build a case.
