    Default Tax Intercept on Arrears

    State of Florida-

    Need to understand when a tax refund would be intercepted to pay back support.

    Order signed recently, and as part of the order, NCP has to pay for 2 years prior at so much a month. Is this amount considered "arrears" and will the IRS take the tax refund to pay back the 2 years retro?

    Or, does the NCP have to miss monthly payments for it to be considered for tax refund intercepts?

    How "recently" was the order recently signed?
    If you wanted babies all to yourself, you should have created them by yourself. Until you do that, children have the right to BOTH parents, especially since you found them suitable to procreate with.

    December 2009 payment was ordered to mid-January

    Sorry, I wasn't clear. NCP starts paying mid-January.

    The rate the court set to pay the back support is pretty low. It will take over 25 years to pay back the retroactive support, so I wondered if they intercept tax refunds to help get this paid back faster. thanks

    They will eventually get around to filing a tax intercept if he is paying through DOR, but December 2009 is MUCH too late in order to get anything done for the 2009 tax year.

    It's too late for a refund intercept to be done for the 2009 return. However, tax refunds can be intercepted for retro support. Talk to your DOR caseworker and ask them to notify the IRS for an intercept. They send the intercept notices to the IRS in Oct and Nov, so if there is still a retro balance in Sept, contact the DOR and remind them about sending an IRS notice.

    At the rate they calculated repayment, there will be a lot of Septembers until the balance is paid off!!!
