    Default Breaking Lease in Pennsylvania

    I signed a lease in December 2009 with a move in date of 12/15/09. The heater was not working at the time of signing and the stove/oven needed to be replaced. The landlord promised to have both done before I moved in. I paid for only half of December (because of my move in date) and I also put down a security deposit (one full month rent). The heater did not get fixed until 1/10/10 (there was no heat until that time) and the stove/oven still is completely inoperative and has not been replaced. I have been staying with a friend because I have a child and need a functional kitchen. I have not paid for January yet because I told the landlord I would only pay when I was living there (and that would be when he gave me heat and a working kitchen). However I did pay to have the two large oil tanks filled (1/4/10--before heat was fixed.
    I am needing to find a place immediately (my ex is getting very upset ---and rightly so I believe-- that I do have a home yet with a kitchen etc). Can I break this lease and get some money back?

    i believe you could break the lease because the apartment manager did not keep up with his/her word. the apartment should have been in a living condition before you moved in, not after you move in. so i don't see anything unlawful with it

    Read this brochure. If the only current problem is that the oven doesn't work (are you speaking of the oven, stovetop, or both?) you probably would be expected to use one of the remedies short of trying to escape your lease, such as "repair and deduct".
