    Default Misdemeanor Charge

    To make a long story short my husband and I got into an argument. things escalated, we got in eachothers face. He was talking to me in my face moving his hands up and down, I turned my head to ignore him, he got upset and tapped me at the end of my face. Not meaning to tap me , I just freaked out. I had no blood or anything hurt on my face. Well I got up because I could not believe what just happened, I went towards him he had his hand out pushed against my chest. I calmed down and then called the police. He did go to jail. For 24 hours, when it was only suppose to be for a 12 hour hold. After he got out we talked. things are better then ever. We both have an understanding and promised that if things get out of hand one of us will leave. All in all my husband is a good man and a good father. He holds a very good job and has never been in jail. This is his only misdemeanor charge. We still have to go to court. I wish I had never called the police. We now have to go to court. My question is what do you think the judge will do?Or what can I do if anything to make sure he does not go to jail. It was an unfourtunate thing that happened , and we both learned from it. I just want to get over this. What do you think the judge will do? He has no prior arressts or history of any jail time.

    He probably won't go to jail - typically he will get probation, and may even be eligible for a diversion program.

    Please forgive me for any undue skepticism, but if I were a judge and heard your story I would think you were making excuses for him.

    Default Just Curious?

    Should he get a lawyer? If so how much should he expect to dish out? What would be the best advise you can give me in dealing with this situation?
